21 August 2024 - summary of responses published

In February 2024, we published guidance on content moderation and data protection, which is the first piece in our planned series of guidance products on online safety technologies. Our guidance, in parallel with our ongoing collaborative work with Ofcom, will support organisations to meet both their data protection and online safety responsibilities. This is part of our ongoing commitment to ensure regulatory coherence between the data protection and online safety regimes. We announced this in our 2022 joint statement with Ofcom on online safety and data protection.

To support the development of this guidance, we conducted a public call for views on data protection and content moderation from 26 April to 9 June 2023.

We have published a summary of responses to our call for views on data protection and content moderation.

We would like to thank respondents for engaging with our call for views. The responses we received informed the development of our guidance on content moderation and data protection. We plan to keep this guidance under review and update it where appropriate.

Call for views on content moderation and data protection

As part of our call for views we wanted to understand more about:

  • How content moderation solutions use people’s personal data, and how the solutions are being used or developed more generally.
  • Where clarification is needed on the application of UK GDPR, DPA 2018 and PECR to content moderation.
  • What challenges organisations are facing relating to data protection when they deploy content moderation processes.

We are launched this call for views to develop our knowledge and to ensure that our guidance was meaningful to organisations.
